The Federal Court of Appeals ruled Wednesday that Ashley Judd could sue Harvey Weinstein for sexual harassment.
A panel of three arbitrators from the 9th U.S. Court of Appeals found that the actress should be able to prosecute both parts of her lawsuit against Weinstein. The court dismissed her allegations of sexual harassment, but left her claim for defamation intact.
Judd was one of the first people to publicly accuse Weinstein. The court agreed that the law could apply to situations such as the one Judd faced when she negotiated with Weinstein but did not work for him. The case is likely to be tried early next year.
“Weinstein was uniquely positioned to use coercive force or leverage over Judd, who was a young actor at the beginning of his career at the time of the alleged harassment,” wrote Mary Murguia, a U.S. district judge.
“In addition, given Weinstein’s very influential and ‘necessary’ presence in the film industry, the relationship was one that would be difficult to end ‘without tangible difficulties’ for Judd, whose livelihood as an actor depended on casting roles.”

Judd’s lawyers made it clear when she filed a lawsuit that she had partially filed a lawsuit to extend the application of the Predatory Protection Act in Hollywood and on Wednesday praised the 9th Circuit decision.
