The Federal Court of Appeals ruled Wednesday that Ashley Judd could sue Harvey Weinstein for sexual harassment.

A panel of three arbitrators from the 9th U.S. Court of Appeals found that the actress should be able to prosecute both parts of her lawsuit against Weinstein. The court dismissed her allegations of sexual harassment, but left her claim for defamation intact.

Judd was one of the first people to publicly accuse Weinstein. In 2018, she filed a lawsuit, claiming that at a meeting at the Beverly Hills Hotel in late 1996 or early 1997, the producer tried to force her to watch him shower and give him a massage, then smeared her in Hollywood as a “nightmare.”

Judd’s lawyers sued Weinstein under a California law that prohibits sexual harassment by people other than employers with professional force, including teachers and landlords.

The court agreed that the law could apply to situations such as the one Judd faced when she negotiated with Weinstein but did not work for him. The case is likely to be tried early next year.

“Weinstein was uniquely positioned to use coercive force or leverage over Judd, who was a young actor at the beginning of his career at the time of the alleged harassment,” wrote Mary Murguia, a U.S. district judge.

“In addition, given Weinstein’s very influential and ‘necessary’ presence in the film industry, the relationship was one that would be difficult to end ‘without tangible difficulties’ for Judd, whose livelihood as an actor depended on casting roles.”

Judd’s lawyers made it clear when she filed a lawsuit that she had partially filed a lawsuit to extend the application of the Predatory Protection Act in Hollywood and on Wednesday praised the 9th Circuit decision.

“This is an important victory not only for Ms. Judd, but for all victims of sexual harassment in professional relationships,” said Judge’s lawyer Theodore Boutrous Jr. in a statement.

“The Court of Justice has rightly held that California law prohibits sexual harassment and retaliation by film producers and others in strong positions, including outside employment. We look forward to continuing this trial against Mr Weinstein before the trial. “

An email seeking comment from Weinstein’s representative, Phyllis Kupferman, was not returned immediately. Kupferman has previously said that Weinstein was not harmed by Judd’s career, but promoted it, approving it for roles in his two films.

The verdict comes two weeks after a judge in New York refused to settle a $ 19 million dispute between Weinstein and many women who sued him for sexual abuse. Judd was not involved in the proposed agreement.

The 52-year-old stars of “Kiss The Girls” and “Double Jeopardy” were among the women who told Weinstein’s stories in the New York Times and New Yorker in 2017, making the #MeToo movement a global phenomenon.

The following year, she sued Weinstein after director Peter Jackson said in an interview that Weinstein had warned him against working with Judd when he considered her a Lord of the Rings movie.

The trial was suspended following the end of Weinstein’s criminal proceedings in New York, where the 68-year-old producer was convicted of rape and sexual assault on two women. He faces similar accusations in Los Angeles.

Weinstein has repeatedly denied engaging in any non-consensual sexual activity.
